Judge orders NJ couple to turn over money raised for homeless man

After Johnny Bobbitt Jr., a homeless man with just $20 in his pocket, gave stranded motorist Kate McClure the money for gas last October, the woman and her boyfriend raised $400,000 to help him out.

According to CNN affiliates WPVI and KYW, McClure and Mark D'Amico had the money they raised on GoFundMe in their personal accounts, Bobbitt's lawyer said.

As reported by the BBC, Bobbitt, a 34-year-old military veteran and former firefighter, has this week launched a lawsuit against the couple, claiming he didn't get all the money he is owed.

The couple deny those claims, saying they're wary of giving Bobbitt large sums because they fear he would buy drugs. She didn't have money to repay him at the time, but sought him out days later to give him the money, and visited him a few more times to bring food and water. Fallon said D'Amico left them no choice but to file a lawsuit.

McClure and D'Amico raised almost $403,000 on GoFundMe starting late past year to buy Bobbitt, among other things, his own home and "dream" truck: a 1999 Ford Ranger.

Bobbitt met with a financial adviser, but never had access to the money or signed paperwork for a trust, according to the Philadelphia Inquirer. To thank him for his generosity, McClure set up a GoFundMe page and encouraged people to donate so Bobbitt would no longer have to live on the streets.

On Monday, McClure and D'Amico appeared on "Today", telling Megyn Kelly that about $150,000 was left, Fallon said.

Badway said Bobbitt requested that the vehicles be put in McClure's name.

Johnny Bobbitt spent his last $20 on gas for Kate McClure when she was stuck on I-95 in Kensington previous year.

They are now preparing the accounting that will "show where the money went", Badway said. Along with demanding that the pair provide a full account of where the money was spent, the judge ordered any and all remaining money to be given to Bobbitt.

Bobbitt's lawyer said, "We're filing an injunction to enjoin them from doing anything with the money other than delivering it to us or paying Johnny Bobbitt".

Bobbitt was still contacting McClure and D'Amico as of August 14 to ask for money, Badway said.

Indeed, D'Amico was belligerent over the situation. Some of the money GoFundMe donors gave to him ended up in the pockets of drug dealers, Bobbitt told the Inquirer.

Bobbit once blew through $25,000 ($A35,000) cash in under two weeks, they claimed to the Philadelphia Inquirer.

The couple also bought Mr Bobbitt a camper van with some of the funds and parked it on land Ms McClure's family owns in Florence.

"This is a well thought out plan that Johnny his lawyer and financial advisor came up with in order to give Johnny the means to acclimate back into a "normal" life and also to protect him and ensure he has a bright future", McClure wrote.
