Samsung, Apple reach settlement over design dispute

"Whereas the court has been advised by the parties that the above-entitled action has been settled, all remaining claims and counterclaims in this case are hereby dismissed with prejudice", US District Court Judge Lucy Koh wrote. However, the terms of the settlement were not disclosed.

The legal dispute between the two tech giants started in 2011 when Apple sued Samsung, who countersued Apple the same year.

The news follows Apple winning a United States dollars 539 million jury award against Samsung in May in a retrial over damages stemming from their original lawsuit in federal court in San Jose, California, which ended with a USD 1.05 billion verdict against Samsung.

Michael Risch, a professor of patent law at Villanova University, said that because of the recent verdict the settlement likely called for Samsung to make an additional payment to Apple.

In May, a USA jury awarded Apple US$539 million, after Samsung had previously paid Apple US$399 million to compensate for patent infringement - Samsung would need to make an additional payment to Apple of almost US$140 million if the verdict was upheld. The amount of damages due APPLE has been bounced around through a series of appeals for years.

Apple spokeswoman Rachel Wolf Tulley provided this statement: "We believe deeply in the value of design, and our teams work tirelessly to create innovative products that delight our customers".

The dramatic turn of the lengthy legal battle came a month after retrial jurors in the Northern District of California handed Apple $538.6 million in damages for Samsung violating design and utility (technical) patents that included the infamous "rounded corner" patent. A jury in May ordered Samsung to pay Apple $539m for infringing on its patents. For the companies, the long-running battle was about more than money.

"We're grateful to the jury for their service and pleased they agree that Samsung should pay for copying our products".

Even so, Carrier added that Samsung and Apple "likely realized that it was time to move on".
